General Terms and Conditions (GTC) of Wemarto GmbH for the Giltori online shop

§ 1 Scope and provider

(1) These GTC apply to all orders placed through the Giltori online shop (giltori.de).

(2) The provider and contractual partner is Wemarto GmbH, Schöne Aussicht 45, 61206 Wöllstadt, Germany (hereinafter 'Giltori' or 'we'). Contact: info@giltori.de.

(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

§ 2 Conclusion of contract

(1) The presentation of products in the online shop is not a legally binding offer but an invitation to order.

(2) By completing the order process via the order button, you submit a binding offer to purchase the goods in your cart.

(3) The contract is concluded when we accept your order by an order confirmation by email or by shipping the goods. An automatic acknowledgement of receipt does not yet constitute acceptance.

§ 3 Prices and shipping costs

(1) All prices are final prices and include statutory VAT. They are exclusive of shipping costs.

(2) Shipping costs are shown separately during the order process; details under 'Shipping'.

(3) For deliveries outside the EU, additional customs and import duties may apply and are to be borne by the customer.

§ 4 Payment

(1) Payment is made via the payment methods offered during the order process.

(2) The purchase price is due immediately upon conclusion of the contract.

§ 5 Delivery

(1) Delivery is made to the delivery address provided by the customer.

(2) Delivery times are stated under 'Shipping' and begin upon conclusion of the contract (for prepayment, upon receipt of payment).

§ 6 Retention of title

The goods remain our property until payment has been made in full.

§ 7 Right of withdrawal

(1) Consumers have a statutory right of withdrawal. Details can be found in our withdrawal policy ('Right of withdrawal').

(2) The right of withdrawal is excluded for custom-made goods and items produced to individual customer specifications.

§ 8 Warranty / liability for defects

(1) Statutory warranty rights apply. For consumers, the limitation period for claims for defects is two years from receipt of the goods.

§ 9 Liability

(1) We are liable without limitation for damage arising from injury to life, body or health, and in cases of intent and gross negligence.

(2) In the case of simple negligence, we are liable only for the breach of an essential contractual obligation, and limited to the foreseeable damage typical for the contract.

(3) Otherwise, liability is excluded. Liability under the German Product Liability Act remains unaffected.

§ 10 Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.

(2) Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
